1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Man Aya DataLink ("we," "us" or "our"), concerning your access to and use of the Man Aya DataLink website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Site and you must discontinue use immediately.

2. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights.

3. User Representations

By using the Site, you represent and warrant that:

  • All registration information you submit will be true, accurate, current, and complete
  • You will maintain the accuracy of such information and promptly update such registration information as necessary
  • You have the legal capacity and you agree to comply with these Terms of Service
  • You are not a minor in the jurisdiction in which you reside
  • You will not access the Site through automated or non-human means
  • You will not use the Site for any illegal or unauthorized purpose

4. Products and Services

All products and services displayed on the Site are subject to availability. We reserve the right to discontinue any products or services at any time for any reason. Prices for all products and services are subject to change without notice. We make every effort to display as accurately as possible the colors and features of our products. However, we cannot guarantee that your computer monitor's display of any color will be accurate.

5. Purchases and Payment

We accept the following forms of payment: Mobile Money (MTN, Vodafone, AirtelTigo), Bank Transfer, and Card Payments. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.

6. Refund Policy

Due to the nature of digital products and data bundle services, all sales are final and no refund will be issued once a transaction has been completed. However, if you experience any issues with your purchase, please contact our support team within 24 hours and we will work to resolve the issue. For affiliate program subscriptions, please refer to the specific terms outlined in your affiliate agreement.

7. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. Prohibited activities include, but are not limited to:

  • Systematically retrieving data or other content from the Site
  • Tricking, defrauding, or misleading us and other users
  • Circumventing, disabling, or otherwise interfering with security-related features
  • Disparaging, tarnishing, or otherwise harming us and/or the Site
  • Using any information obtained from the Site in order to harass, abuse, or harm another person
  • Attempting to impersonate another user or person
  • Selling or otherwise transferring your profile

8. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site, even if we have been advised of the possibility of such damages.

9. Governing Law

These Terms shall be governed by and defined following the laws of Ghana. Man Aya DataLink and yourself irrevocably consent that the courts of Ghana shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
